General Terms and Conditions of Sale

Preamble

These General Conditions of Sale (GTC) govern the subscription and use of paid subscriptions to services offered by MyUniSpace, a SaaS suite of tools operated by EI Hugo Rochette (UniGency).

By subscribing to a paid subscription, the customer acknowledges that he has read the Terms and Conditions of Use (CGU) and these Terms and Conditions and accepts them without reservation.

These Terms and Conditions define the obligations of the parties, protect MyUniSpace against possible complaints and ensure transparency in the contractual relationship between MyUniSpace and its customers. They comply with the legal obligations in force.

Article 2 – Purpose

These Terms and Conditions set out the terms and conditions for subscription and use of MyUniSpace's paid subscriptions, allowing customers to access services and features advanced in comparison to the free version.

These include:

The essential characteristics of the digital services provided,
Payment and billing conditions,
Conditions for suspension and termination,
The legal guarantee of conformity and the legal guarantee of hidden defects,
Appeals in the event of a dispute.

Article 3 – Services and subscriptions

3.1 – Description of services

The services included in MyUniSpace's pay subscriptions are detailed on the tariff page, which is available on the official website.

3.2 – Prices and methods of payment

Prices are shown in euro excluding taxes. As an Individual Business, VAT is not applicable in accordance with Article 293b of the CGI (or specify whether you are subject to it). Rates are posted on the official website. Payments are processed via Stripe, a certified PCI-DSS provider.

MyUniSpace reserves the right to change the price of the proposed subscriptions at any time. Subscribers will be informed of any tariff changes at least 30 days prior to their effective date by email or any other appropriate means of communication.

If the new tariff is refused, the subscriber may terminate his or her subscription without charge before the date of application of the new tariff. In the absence of termination within this period, the new tariff will be considered accepted by the subscriber.

Methods of payment accepted:

Bank card only (Visa, Mastercard, etc.);
PayPal.

In case of default, MyUniSpace may suspend access to services after several unsuccessful collection attempts. Any delay in payment by a professional customer will result in the application of a flat-rate recovery fee of 40 €.

3.3 – Duration and renewal

Monthly subscription : Automatic renewal every month, unless terminated.

The customer can manage his subscription and billing from his user space. The customer may terminate his subscription at any time without notice.

Article 4 – Contract performance and delivery of services

Access to digital services is provided immediately after confirmation of payment. No physical support is issued.

As SaaS services are provided online and automatically updated, no user action is required to benefit from the latest security versions and fixes.

Article 5 – Right of withdrawal and reimbursement

5.1 – No right of withdrawal

In accordance with Article L.221-28 13° of the Consumer Code, the right of withdrawal may not be exercised for the supply of digital content not supplied on a physical medium the performance of which has begun after the express prior consent of the consumer and the express waiver of his right of withdrawal.

The customer expressly acknowledges that by validating his payment and accessing digital services MyUniSpacehe renounces his right of withdrawal by becoming fully aware of this provision.

5.2 - Refund policy

No refund will be granted after subscription unless:

Prolonged technical failure due to MyUniSpace ;
Double accidental sampling;

Article 6 – Sponsorship programme

MyUniSpace offers its users a sponsorship program allowing them to benefit from exchangeable sponsorship points for rewards.

1. Sponsorship arrangements

Each customer has a unique sponsorship link within his/her personal area, which he/she can share with any person not yet registered on MyUniSpace. When a new user (hereinafter « The Daughter ») creates an account via this link and checks its e-mail address, a (1) sponsorship point is definitely credited to the sponsor's account.

2. Allocation of additional points

If Filleul subscribes to a subscription Basic, two (2) additional points are credited to the sponsor account.
If Filleul subscribes to a subscription Pro, three (3) additional points are credited.

These points are said active, i.e. they vary according to the subscription status of the Girl:

In case of a change to a lower offer (downgrade), the number of points is adjusted downwards.
In the event of a change to a higher (upgrade) offer, the number of points is adjusted upwards.
If the Filleul subscription is terminated, the corresponding points shall be deleted.

The initial points related to simple registration with e-mail verification remain final and are not affected by these adjustments.

3. Awards and bearings

The client can consult, on the sponsorship page, the different levels and rewards available depending on the number of active sponsorship points. These rewards may evolve at any time.

If a customer no longer has the number of points required for a reward already obtained (excluding physical rewards), MyUniSpace reserves the right to withdraw the said reward. On the other hand, physical rewards, once delivered, cannot be withdrawn.

4. Additional provisions

Sponsorship points cannot be transferred, transferred or exchanged for money.
The sponsorship program is reserved for users with a valid personal account that complies with the GTC and GTC.
MyUniSpace reserves the right to modify or terminate the sponsorship programme at any time without notice, without any right to compensation.

Article 7 – Legal guarantee

6.1 – Legal guarantee of compliance and guarantee of hidden defects

Digital services MyUniSpace are guaranteed in accordance with the description provided and free from hidden defects.

Article 8 – Liability and insurance

8.1 - Responsibility for MyUniSpace

MyUniSpace committed to providing access to services within its technical capabilities. However, MyUniSpace shall not be liable in the event of:

Temporary interruptions related to service maintenance,
Technical updates requiring a temporary shutdown of services,
Incidents beyond his control, including failure, computer attack, cybersecurity or force majeure.

8.2 - Customer responsibility

The customer is entirely responsible for the use he makes of the services of MyUniSpace. In particular, it undertakes to:

Do not share access identifiers with third parties,
Use the services in accordance with existing laws and EMCs,
Respect basic cybersecurity rules to protect its data and those of other users.

In the event of a breach of CGUs or fraudulent use, MyUniSpace reserves the right to suspend or terminate the customer's subscription without notice and without a pro rata refund.

Article 9 – Mediation and dispute resolution

In the event of a dispute, the customer can use the EU's online dispute resolution platform before any legal action.

These Terms and Conditions are governed by French law. In the event of a continuing dispute, the competent court shall be that of the head office of MyUniSpace.
